General terms and conditions
General terms and conditions of use and service
These terms govern the use of the ClearFiat site and each conversion operation of crypto-assets into fiat currency. Read them before validating a quote: a crypto-asset transfer is irreversible.
The operator identified in the legal notices is not authorised as a crypto-asset service provider under Regulation (EU) 2023/1114 and is not supervised by any competent authority of the European Union. You therefore do not benefit from any of the protections that this Regulation attaches to authorisation.
Purpose and description of the service
ClearFiat is a service for converting crypto-assets into fiat currency, operated by the operator identified in the legal notices. You request a quote, you send the crypto-assets to the deposit address indicated to you, then the operator pays you the corresponding fiat amount to the receipt method you have chosen. These terms govern access to the site and each conversion transaction. The service does not include any investment advice, any recommendation or any management on your behalf. The local payment rails listed in the technical catalogue of the service are not available and cannot be selected.
- Accepted crypto-assets: BTC on the Bitcoin network, ETH on Ethereum, USDT and USDC with explicit choice of network
- Available receipt methods: SEPA transfer, SWIFT transfer, PayPal
- Unavailable payment rails: ACH, Pix, SPEI, UPI, Interac, Faster Payments, NPP, DuitNow, mobile money
- Fiat currencies served: EUR, USD, GBP, CHF, CAD, AUD, PLN, BRL, MXN, ARS, INR, IDR, MYR, THB, VND, PHP, HKD, JPY, KRW, TRY, AED, KES
Regulatory status and access to the service
The operator identified in the legal notices is not authorised as a crypto-asset service provider under Regulation (EU) 2023/1114. The service is not supervised by any competent authority of the European Union and no authorising authority can be named in that capacity. No statement on the site, no message and no communication may be understood as the announcement of an authorisation, registration or supervision. The status described here is that of the version date indicated in the last section.
- You do not benefit from any of the protections provided for by Regulation (EU) 2023/1114: segregation of assets, regulatory own funds, enforceable complaint procedure, liability in the event of loss of crypto-assets
- The crypto-assets delivered and the funds to be paid are not covered by any deposit guarantee scheme or any investor compensation scheme.
- No recourse may be sought before a financial supervisory authority; your recourse before consumer protection authorities, data protection authorities and the courts remains fully available.
- None of these terms restricts the rights granted to you by the mandatory law of your country of residence.
Customer account and access conditions
Opening an account is free and requires a valid email address and a password. The service is reserved for adults with legal capacity to contract and acting on their own behalf. You are responsible for keeping your password and recovery codes confidential, and you must report any unauthorised access without delay. The recipient details you record must be accurate and up to date; where the destination account belongs to a third party, you must be entitled to use it and inform that third party that their details are processed by ClearFiat in order to execute the payment. Account data are processed in accordance with the privacy policy.
- Email address and password essential for creating the account
- Beneficiary details essential for executing the payment: without them, the conversion cannot be paid
- Identity elements requested in the cases provided for in the section devoted to verifications: failing that, the transaction is not executed and the crypto-assets received are returned
- Account closure possible at any time, without fees or penalty
Quotation and formation of the contract
Each transaction begins with a firm quotation, calculated from several price providers and valid for 120 seconds. If the spread between price providers exceeds 150 basis points, the quotation will not be maintained and a new request will be required. Before confirming, you will see the crypto-asset, the network, the amount to deposit, the rate selected, the fees, the net fiat amount and the method of receipt, and you may review and amend each item. Confirmation of the quotation constitutes an order with a payment obligation and forms the contract. The terms and price of a confirmed quotation remain unchanged during its validity period and during the subsequent deposit window, including if these Terms are modified in the meantime.
- Quotation validity period: 120 seconds
- Maximum permitted spread between price providers: 150 basis points
- Complete and editable summary before confirmation
- No deposit within the window: the order lapses, with no fees or amounts due by either party
- Each transaction receives a reference, to be kept for any subsequent communication
Prices, fees and amounts
The service fees are 1,90 per cent of the converted amount, i.e. 190 basis points. A minimum fee amount applies per currency: 2,50 EUR for the euro, 3,00 USD for the United States dollar, and the corresponding minimum for each of the other currencies served. The net fiat amount that will be paid to you is displayed before the quote is validated, after deduction of fees, and no additional charge is subsequently added by ClearFiat. The blockchain network fees that you use to send your crypto-assets are borne by you and are not collected by ClearFiat. Any fees that the beneficiary's bank, an intermediary bank or the payment service provider would apply upon receipt are not collected by ClearFiat and are beyond its control.
- Service fees: 1,90 per cent of the converted amount
- Minimum fee: 2,50 EUR, 3,00 USD, or the minimum applicable to the chosen currency
- Minimum amount per transaction: equivalent of 70 EUR
- Maximum amount per transaction: equivalent of 50 000 EUR
- Amounts expressed in EUR equivalent are assessed at the exchange rate used for the transaction
- No other fees are collected by ClearFiat
Deposit of crypto-assets and network selection
After confirmation, you have 30 minutes to send the crypto-assets to the specified deposit address. Deposits are detected by polling the network every 30 seconds. For USDT and USDC, the network must be chosen explicitly: no fallback network is applied and a transfer on an unsupported network cannot be recovered. A crypto-asset transfer is irreversible by nature; check the address, the network and the amount before confirming the transfer from your usual tool. A deposit received outside the 30-minute window, or of an amount different from the quoted amount, is processed in accordance with the rules described in the following section.
- Deposit window: 30 minutes from confirmation of the quotation
- Deposit detection frequency: 30 seconds
- BTC on the Bitcoin network, ETH on Ethereum, USDT and USDC on the network you designate
- The price of crypto-assets is volatile: outside a confirmed and still valid quotation, no fiat amount is guaranteed
- Retain the transaction identifier: it serves as proof of your transfer.
Verification and payment of funds.
Each deposit is checked by a person, then the fiat payment is triggered manually by the operator. There is no automatic reconciliation between the transaction received and the order, which means that the payment is never instantaneous. The payment is initiated upon completion of this verification; the effective date of crediting then depends on the recipient institution or the payment service provider, while any delay attributable to the verification itself remains the responsibility of the operator. Compliance of the deposit is assessed according to objective and verifiable criteria set out below, and the transaction recorded on the blockchain constitutes proof of your transfer. A summary of each transaction is made available to you in your account, in a form that you can save and keep, with the exchange rate applied, fees, net amount, method of receipt and status history.
- Compliance criteria: deposit address, network, amount, timestamp, network confirmations.
- Deposit received outside the window or with a different amount: a new quote is offered to you, or the crypto-assets are returned to you.
- Deposit below the minimum or above the maximum: return to the address you designate.
- Payment rejected by the recipient institution: it is reissued to the corrected payment details you provide, or the crypto-assets are returned to you.
- Any return is made in crypto-assets, after deducting only the network fees.
Identity checks, suspension and refusal of transaction.
Beyond the equivalent of 12 000 EUR converted over 12 months, additional identity information is requested from you before the operation is executed. This threshold is a fraud prevention measure decided by the operator; it does not constitute the performance of a regulatory obligation, as the operator is not currently an authorised provider. Identity information may also be requested below this threshold where verification of an operation justifies it. If you do not provide the requested information, the operation is not executed and the crypto-assets received are returned to you at the address you designate. An operation may be suspended or refused only for one of the grounds listed below, you are informed of this with an indication of the ground, and no sum is retained in respect of an operation that has not been executed.
- Deposit received outside the 30-minute window.
- Unsupported crypto-asset or network.
- Amount less than the equivalent of 70 EUR or greater than the equivalent of 50 000 EUR
- Spread between exchange rate providers exceeding 150 basis points at the time of the transaction.
- Identification details not provided when requested.
- Substantiated suspicion of fraud, identity theft or use of the account by a third party
- Incorrect receiving details or payment refused by the recipient institution.
No right of withdrawal.
The fiat amount paid to you depends on the price of crypto-assets, i.e. on market fluctuations which are beyond the operator's control and may occur during the withdrawal period. Consequently, the conversion transaction does not give rise to a right of withdrawal, pursuant to Article L221-28, paragraph 2 of the French Consumer Code and Article 16, point (b) of Directive 2011/83/EU from which that provision derives. If the contract were to be classified as a financial service provided at a distance, the exclusion would result from Article L222-9, paragraph 5 of the same Code, which covers services whose price depends on fluctuations in financial markets. This absence of a right of withdrawal is brought to your attention before validation of each quote. However, opening an account is free of charge, entails no payment obligation, and you may close your account at any time.
- Basis for the exclusion: Article L221-28, paragraph 2 of the French Consumer Code.
- Equivalent in the Union: Article 16, point (b), of Directive 2011/83/EU, as transposed into the law of your country of residence
- Subsidiary basis: Article L222-9, 5° of the Consumer Code
- Operations concerned: only conversions of crypto-assets into fiat currency
- Not concerned: the opening and closing of the account, which are free and without charge
Liability and warranties
The operator is strictly liable for the proper execution of the conversion transaction, whether the obligations are performed by the operator itself or by other service providers it uses, in accordance with article L221-15 of the Code de la consommation. The operator may only be released from liability by demonstrating that the non-performance or improper performance is attributable to you, to an unforeseeable and insurmountable event caused by a third party outside the contract, or to a case of force majeure. No compensation cap is stipulated and no category of damage is excluded in advance. However, you remain responsible for the consequences of a transfer made on an unsupported network, to an address other than the one indicated to you, or to receiving details that you have communicated inaccurately, these operations being irreversible and beyond the operator's control. No commercial guarantee is offered, and the legal guarantees attached to the non-performance of a service contract under the mandatory law of your country of residence apply without restriction. You remain solely responsible for the tax returns that your personal situation requires.
- Covered by the operator's liability: an input error on its part, a payment made to the wrong beneficiary due to its own act, a delay attributable to its own verification
- At your expense: a network or address error made by you, inaccurate receiving details, blockchain network fees
- No limitation, no ceiling and no exclusion of damage is stipulated in favour of the operator
- The facts established by the public blockchain are enforceable against both parties
Complaints, mediation and dispute resolution
Any complaint relating to a transaction must be submitted in writing to the contact address published on the legal notices page. The site's contact form helps you gather the relevant information; only a request received at that address constitutes the filing of a complaint. Filing a complaint is free of charge, your request is recorded and examined, and a reasoned response is sent to you in writing. Recourse to a consumer mediator is a free right of the consumer; as of the version date of these terms, the operator has not joined any mediation scheme, so no mediator's contact details can be given here without being inaccurate. Recourse to mediation remains an option available to the consumer and never constitutes a mandatory prerequisite to bringing the matter before a court. The European Online Dispute Resolution platform ceased to exist on 20 July 2025 pursuant to Regulation (EU) 2024/3228: no link to this service is published, because it no longer exists.
- Items to attach to a complaint: transaction reference, date, crypto-asset and network, amount, transaction identifier, method of receipt
- The complaint is free of charge and may be written in one of the languages in which the site is published
- Cross-border dispute: the European Consumer Centres Network may be contacted, in particular the European Consumer Centre France
- Bringing the matter before the courts remains open at any time, without any prerequisite
Amendment, termination, applicable law and language
These terms may be amended, in particular to take account of changes in the service or the legal framework. You will be notified of any amendment with reasonable notice before it enters into force and you may refuse it by ceasing to use the service and closing your account, without any fees or penalties. A quotation already validated remains governed by the terms and the price in force at the time of its validation, throughout its validity period and during the deposit window. You may close your account at any time; the operator may only terminate it for one of the reasons listed in the section on suspension and refusal, with reasonable notice and without retaining any amount owed to you. Where you contract as a consumer, the contract is governed by the law of your country of habitual residence in accordance with Article 6 of Regulation (EC) No 593/2008, and no provision of these terms designates another law to your detriment. You may bring proceedings before the court of your domicile, and any action brought against you may only be brought before that court.
